On or about November 19, 2016 the County of Grant will request the US Department of Housing and Urban Development to release federal funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383) for the following project:

PROJECT TITLE OR NAME: Tu Casa Rehabilitation Center

PURPOSE OR NATURE OF PROJECT: The purpose of the project is to provide Grant county residents with much needed local public health services.

LOCATION OF PROJECT: The proposed project is situated in the community of Silver City, New Mexico directly east of the existing New Mexico Human Services Department building at 2088 32nd Street Bypass. It is located on the Fort Bayard, NM 7.5-minute U.S. Geological Service (USGS) quadrangle map in Section 23, Township 17 South, Range 14 West.
Census Tract(s) 9647.00


PROJECT SUMMARY: Grant County proposes to develop a 4-acre parcel for a treatment center for Grant County residents with substance abuse and behavioral health needs. The proposed Tu Casa Rehabilitation Center would consist of a new 8,000-square-foot building, paved parking for 40 vehicles, landscaping, and an access road to connect the facility with a main road. The parcel is currently undeveloped and vegetated.

An environmental review of the project has been made by the Grantee and is available for public examination and copying at the office noted above. Based on this review, the Grantee has determined that a request for release of project funds will not significantly affect the quality of the human environment and hence, an environmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (PL 91-910).

The reasons for the decision not to prepare an environmental impact statement are as follows:
As a result of resource evaluations and agency consultations, it has been determined that a new rehabilitation center is not an action that would significantly affect the quality of the environment. This project will not negatively affect existing land use or other environmental concerns. Thus, no Environmental Impact Statement is required. The consensus is that implementation of the Tu Casa Rehabilitation Center will correct a long standing health care need/problem that has existed in Grant County.

All interested agencies, groups or persons disagreeing with these decisions are invited to submit written comments for consideration by the Grantee by November 19, 2016. All comments must clearly specify which decision they object to - The Finding of No Significant Impact or the Request for Release of Funds. All comments so received will be considered by the Grantee prior to its taking any administrative action or requesting release of funds on the date listed immediately above.

The Grantee will undertake the project described above with Block Grant funds from the US Department of Housing and Urban Development (HUD), under Title I of the Housing and Community Development Act of 1974. The grantee is certifying to HUD that the County of Grant and Michael Larisch, Planning and Community Development Director in his/her official capacity, consent to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision-making and action, and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Grantee may use the Block Grant funds, and HUD will have satisfied its responsibilities listed in 24 CFR Part 58. HUD will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases:
(a) that the certification was not in fact executed by the Chief Executive Officer or other officer of the Grantee
(b) that the environmental review record for the project indicated omission of a required decision finding, or step applicable to the project in the environmental review process, or
(c) another federal agency has submitted written comments pursuant to Section 309 of the Clear Air Act or Section 102(c) of NEPA.

Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and may be addressed to HUD or Department of Finance and Administration (DFA), Local Government Division (LGD), 407 Galisteo St., Room 202, Bataan Memorial Bldg., Santa Fe, NM 87501. Objections to the release of funds on bases other than those stated above will not be considered by HUD or LGD/DFA. No objection received after 15 days from the date of request for funds listed above will be considered by HUD or LGD/DFA.
