As many will recall the saga began on June 11, 2016 when a caller to 911 reported, and video recorded, a reckless on Highway 180 West heading towards Silver City. When the SCPD finally located the car it had pulled over in front of the Office of Sustainability on Pope Street with District Attorney Francesca Estevez in the drivers seat. (see my 2 previous articles linked below)

Just short of a year later on June 8, 2017 the New Mexico Attorney file 5 criminal complaints in District Court against DA Estevez, Judge Robinson was assigned as Judge and a Preliminary Hearing was set for 9:30 am on June 19. Some time before 9:30 her attorney Jim Foy filed a waver of arraignment and a plea of Not Guilty where-upon a notice was filed into the record, signed by all 4 6th Judicial District judges Recusing themselves from hearing the case; the Judges are Judge J.C. Robinson, Jennifer E. Delaney, Jarod K. Hofacket and Timothy L. Aldrich. The Prosecuting Attorneys from NM AG Office Jeres Rael and Aaron Baca and Defense Attorney Jim Foy had 10 days to find and negotiate a new judge but as of Friday June 30 deadline the Attorney's were mum. If a Judge has not been found then the NM Supreme Court will assign one to come here and hear the case at which time Foy could ask for a Change of Venue to move the case to another Judicial District.

The Charges:

4 are misdemeanor and 1 is a petty misdemeanor with a sentencing guidlines of:
31-19-1. Sentencing authority[;] misdemeanors; imprisonment and fines; probation.

A. Where the defendant has been convicted of a crime constituting a misdemeanor, the judge shall sentence the person to be imprisoned in the county jail for a definite term less than one year or to the payment of a fine of not more than one thousand dollars ($1,000) or to both such imprisonment and fine in the discretion of the judge.

B. Where the defendant has been convicted of a crime constituting a petty misdemeanor, the judge shall sentence the person to be imprisoned in the county jail for a definite term not to exceed six months or to the payment of a fine of not more than five hundred dollars ($500) or to both such imprisonment and fine in the discretion of the judge.

C. When the court has deferred or suspended sentence, it shall order the defendant placed on supervised or unsupervised probation for all or some portion of the period of deferment or suspension.

But; I'm told by a couple of lawyers here that if she is convicted of any of the ethics charges she could have a complaint filed with the NM Supreme Court Judicial Review Committee and could be removed from office. Additionally she could have a complaint filed with the NM Bar Association and ave her license to practice law revoked for some length of time.
