Silver City Council members look on as Mayor Ladner reads a Proclamation defining and reaffirming Silver City's Core Principles of "..inclusiveness, fairness, and equality..." and that the loss of constitutional rights was not necessary for security. Read the Proclamation below and the 2003 resolution that it reaffirms.

As the Sanctuary City movement spreads across the country it was inevitable for it to arrive Silver City and Grant County (Read my previos article HERE). Silver City's Town Council and managers decided to take a stand short of using the term Sanctuary in an attempt to avoid misunderstandings and possible repercussions from the "Bully-In-Chief" in the White House and his henchman Sessions at the Justice Dept.

Unfortunately during the public input and later during the council comments speakers failed to address input by a citizen of Grant County who erroneously felt that Silver City would be protecting criminals because they are immigrants; she and her 2 supporters left with their concerns unaddressed.

"A Reaffirmation and Celebration of the Core Values of the Town of Silver City"

WHEREAS, the Town Council of the Town of Silver City finds that it is appropriate that certain core principals of this Council and the government which it forms be reaffirmed, celebrated, and proclaimed to the inhabitants of the Town, and to all others who may inquire; and

WHEREAS, in Resolution No. 2003-31 entitled “Resolution For The Restoration And Defense of Constitutional Rights", the Town Council affirmed the Town’s values of inclusiveness and protection of persons from unconstitutional activities regardless of source; and

WHEREAS, the Town celebrates the fact that it has faithfully adhered to those principals expressed in Resolution No. 2003-31 and will continue to do so, celebrating inclusiveness, the protection of persons under the law, and the equality of persons regardless of their circumstance; and

WHEREAS, the Town’s Territorial Charter of 1878 provides for the regulation of persons and property for the health, welfare, and safety of the Town, its inhabitants, and visitors, and the Town Council notes that there exists no express or implied power in said Territorial Charter authorizing this government to regulate, detain, or otherwise participate in matters involving possible undocumented persons;

NOW, THEREFORE, I, Ken Ladner, Mayor of the Town of Silver City, and on behalf of the Town Council, do hereby proclaim

A. That the policy declarations and expression of community values of Resolution No. 2003-31 as well as the often expressed Town policies of inclusiveness, fairness, and equality of persons are hereby affirmed and will continue to be made applicable to all Departments and employees of the Town; and
B. The Departments of the Town of Silver City government shall continue the practice of not utilizing their limited resources for searching, surveilling , seizing, or detaining possible undocumented persons who have not committed a crime under state or local law within the Town; and
C. The Departments shall continue their policy of refraining from making any inquiries into the status of citizenship of any person they may encounter; and
D. The Departments shall not oblige any request from any federal law enforcement to detain, surveil, or identify persons of possible undocumented citizenship without a lawful warrant or court order supporting such request; and
E. The Departments of the Town of Silver City government shall not join nor provide resources to any task force or other assemblage of law enforcement created for or acting with a purpose of enforcing federal immigration law.

After the passage of the original "Patriot Act " the ToSC Council wrote and passed Resolution 2003-31 "Restoration and Defense of Constitutional Rights" on 10-28-2003. Grant County and the City of Bayard also passed similar resolutions but have not yet taken any current actions.
